1. Consultation Fee & Booking
All consultations with Daphane Handy / BXD USA require a non-refundable consultation fee of $250, payable at the time of booking. By completing your booking and submitting payment, you acknowledge and agree that you are being charged for a paid consultation session. This fee is non-transferable and non-refundable regardless of attendance.
2. Brand Strategy Sessions
Brand Strategy Sessions are priced at $500 per 90-minute engagement. Full payment is required to secure your session. Sessions not cancelled at least 48 hours in advance are forfeited without refund. BXD USA reserves the right to reschedule sessions due to unforeseen circumstances, with reasonable advance notice provided to the client.
3. Project-Based & Retainer Services
Digital branding, web design, app development, and brand management retainer engagements are governed by individual service agreements executed prior to project commencement. Pricing, deliverables, timelines, and payment schedules are outlined in those agreements. A signed agreement and deposit are required before any project work begins.
4. Payment Terms
All fees are due in full at the time of booking unless otherwise specified in a written service agreement. BXD USA accepts payment via the methods provided at checkout. In the event of non-payment or chargebacks for services already rendered, BXD USA reserves the right to pursue collection and recover associated costs.
5. Refund Policy
Consultation fees are non-refundable. Project deposits are non-refundable once work has commenced. If a project is cancelled by the client prior to commencement, the deposit may be applied as a credit toward future services at BXD USA's discretion. BXD USA does not issue refunds for work completed or delivered in accordance with an agreed scope.
6. Intellectual Property
All deliverables created by BXD USA remain the intellectual property of BXD USA until payment is received in full. Upon receipt of full payment, the client receives a license to use the deliverables as agreed. BXD USA retains the right to display completed work in its portfolio and marketing materials unless otherwise agreed in writing.
7. Confidentiality
BXD USA treats all client information as confidential and will not disclose proprietary business information to third parties without consent. Clients agree not to share, reproduce, or distribute BXD USA's proprietary frameworks, methodologies, or strategic content provided during engagements.
8. Limitation of Liability
BXD USA provides strategic advisory and creative services. Results are not guaranteed. BXD USA is not liable for any indirect, incidental, or consequential damages arising from the use of services or deliverables. Total liability shall not exceed the amount paid for the specific engagement in question.
9. Scheduling & Cancellations
Clients may reschedule a consultation or session with at least 48 hours' notice at no additional charge. Rescheduling requests made within 48 hours of the appointment are subject to a rescheduling fee equal to 50% of the session cost. No-shows forfeit their session fee in full.
10. Agreement to Terms
By booking a consultation, submitting a request form, or entering into a service agreement with BXD USA, you confirm that you have read, understood, and agree to these Terms & Conditions. These terms are subject to change; the most current version will always be available at bxdusa.com.
